Terms of Service
These Terms of Service (“Terms”) govern your use of Code Analyzer for SAP® ABAP® (the “Service”), operated by Winlex (ABN 29321772563) (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.
1. The Service
The Service uses artificial intelligence to generate technical and payroll-related documentation from SAP ABAP source code you submit. The output is an AI-generated draft intended to assist qualified professionals. It is not professional, audit, legal, or compliance advice. See our AI Disclaimer.
2. Accounts
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You must be at least 18 years old and able to form a contract.
3. Acceptable use
You agree that you will not:
- submit code or data you are not authorised to share, analyse, or store;
- use the Service for any unlawful purpose or in breach of any third-party rights or confidentiality obligations;
- attempt to disrupt, overload, reverse engineer, or circumvent the Service, its usage limits, or its security;
- resell or redistribute the Service without our written consent.
4. AI output — accuracy and reliance
AI-generated output may be inaccurate, incomplete, or misleading. You are responsible for independently verifying any output before relying on it, and for any decisions or actions you take based on it. We do not warrant that output is accurate, complete, or fit for any particular purpose, and risk/confidence indicators are estimates, not guarantees or certifications.
5. Intellectual property
- Your content: you retain all rights in the code you submit. You grant us a limited, non-exclusive licence to process it solely to provide the Service to you (including sending it to our AI provider for analysis, and storing it only if you opt in).
- Output: as between you and us, you may use the analysis output generated for you, subject to these Terms.
- The Service: we retain all rights in the Service, its software, and its underlying intellectual property.
6. Plans, billing, and cancellation
- Paid plans are billed on a recurring subscription basis through Stripe.
- Each plan includes a monthly analysis quota. Quotas and prices are shown on the billing page and may change with reasonable notice.
- You can cancel at any time via the billing portal; access continues until the end of the current billing period.
- Except where required by law (including the Australian Consumer Law), fees are non-refundable.
7. Third-party services
The Service relies on third parties (including Anthropic, Supabase, Stripe, and our hosting provider). Your use may be subject to their terms, and we are not responsible for their acts or omissions.
8. Warranties and Australian Consumer Law
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all implied warranties. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability for a failure to comply with a non-excludable guarantee can be limited, it is limited to re-supplying the Service or paying the cost of re-supply.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for loss of profits, data, or goodwill, arising from your use of the Service or reliance on its output. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
10. Indemnity
You agree to indemnify us against claims, losses, and costs arising from your breach of these Terms or your submission of code or data you were not authorised to submit.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to us or others.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Service or by email, and continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
